If you want to ensure timeout > 2, why not then just use:

- 	unsigned long timeout = usecs_to_jiffies(MVMDIO_SMI_TIMEOUT);
+ 	unsigned long timeout = 1 + usecs_to_jiffies(MVMDIO_SMI_TIMEOUT);
