Could you please clarify what you mean by stations not being able to
scan the AP?

No. The part of detecting non-HT overlap is supposed to apply only for
overlapping channels and is fixed here:

The part of stations not being able to scan the AP sounds strange, so I
would like to understand what you meant with that.
