How to prevent unknown action category 3 or invalid frame from crashing hostap daemon

Hello! The server is running debian squeeze version 6.0.2, this is a bare
bones version too, ive only installed what i require, do not have any extra
programs etc. I am using the ath9k module, plus the driver is nl80211. also
the version of hostapd i am using is hostapd v0.7.3, which was downloaded
from the hostapd website and compiled on the server. and when the server
kicks/stops connecting the wireless clients i get a flood of sent probe
request for broadcast ssid's in the hostapd console from all mac addresses
