Yes, I believe the test is supposed to fail without patch 4.

Unfortunately it is an old patch and I do not remember the context and
cannot find more information about why I added it back then. So it may
have been meant as an optimization even back then.

I think I'll revert these in our internal tree. We can always do a
similar change again if problems occur.
