client not connecting VHT mode

Using a mwifiex client connecting to an AP broadcasting VHT, the
wpa_supplicant client is only connecting at 40 Mhz instead of 80 Mhz.
I'm able to connect to the same AP in VHT mode using other clients.

Is this controlled by a config setting? If not, where should I look?
