You don't have regulatory database or your regulatory don't work correctly.
Seems you never set BE and all the time have world regulatory configured.
For world regulatory all 5GHz channels have NO-IR (seems you still
using old iw and you see PASSIVE-SCAN :)

First you have to fix (install) regulatory database. Two options here:
- crda + wireless-regdb
- using kernel option INTERNAL_REGDB + file db.txt in net/wireless/

If you compile kernel, second option will be simpler.
