Hostapd and Ubiquiti SR71-15. 5,8GHz not working!

Hi, I'm using a SR71-15 (5,8GHz a/n) and when I start hostapd the
following message appears:

wlan0: IEEE 802.11 Configured channel (36) not found from the channel
list of current mode (2) IEEE 802.11a

I found some messages from Jouni saying that AP mode isn't allowed to
work, but I didnt understand why.
When I run "iw list" all the channels has a no-IBSS and/or DFS/radar
detection flags, so this prevent Hostap to work, right?
I changed the countrycode with no success.

The question is: What I have to do to configure this card? Someone has a hint?
The ath9k has support for 5,8GHz cards?

I'm using hostap 0.7.3 and kernel 2.6.36.4.
