Despite you asking for HT40, you're only getting a 20 MHz channel 1 which will not support more than 144 Mbps in ideal conditions. The most likely cause is, that the AP has detected another network on channel 5 (or adjacent to that) and therefor is unable (= not allowed) to use channel 1+5.

If you have another AP that is already using a 40 MHz wide channel, it is not possible to have both of them using 40 MHz wide channels without causing overlaps. You may (or may not) be able to force both of them to use 40 MHz channels, but this is neither recommended nor legal.

In residential areas it is not uncommon that you're limited to 20 MHz channel width on the 2.4 GHz band due to the sheer number of wireless networks in range.
