Error with Kernel 3.9

Hello, I haven't seen any traffic regarding problems with the 3.9 kernel,
but perhaps someone else has seen this error and can help solve it?

Whether bringing the interface up prior or not results in the same error:

wlan1 is an rtl8187.
hostapd is version 2.0
hostapd.conf is:

  interface=wlan1
  driver=nl80211
  ssid=test
  channel=1
  hw_mode=b

OS is Slackware 14.0

I successfully use the same hardware when booting kernel 3.2.29, with the
same hostapd.conf.  Not sure which bits of the config file would be most
