Please note that I did not say this would require power save mode being
enabled..

Yes, station mode scanning is in firmware and no, I don't think there is
configuration option for this part in the driver.

Not necessarily.. Background scans are supposed to happen before the
station needs to roam and at this point, it is useful to stop the
current AP from sending data frames. This may not be that useful if the
connection is already lost, though, but in that case it is already too
late to avoid VoIP issues, if a new scan is required.
